Invitation to Bid - Intercom Replacement Project Phase 2

INVITATION TO BID

 

Notice is hereby given that the Board of Trustees of the Vacaville Unified School District (“District”) will receive sealed Bids for the Bid Package # 19-01: Intercom Replacement Project - Phase 2 (“Project”).

 

The Project consists of the replacement and upgrading of intercom systems at Fairmont Charter Elementary School, Orchard Elementary School, Vaca Pena Middle School and Vacaville High School within the District. (Refer to Exhibit E Special Provisions, Section 1.03 Scope of Work.)

Notice is hereby given that the Project is a public works project within the requirements of Division 2, Part 7, Chapter 1 of the California Labor Code, and that each bidder and listed subcontractor is required to be registered pursuant to Labor Code section 1725.5 at the time of bidding.  Failure of the bidder or a listed subcontractor to be registered at the time of bidding shall render the bid non-responsive and unavailable for award.

 

The successful Bidder shall be required to pay its workers on this Project a sum not less than the general prevailing rate of per diem wages and not less than the general prevailing rate for holiday and overtime work for work of a similar character in the locality in which the Project is performed, as provided under California Labor Code sections 1720 through 1861. Copies of the prevailing rate of per diem wages are on file at the District, 401 Nut Tree Road, Vacaville, CA 95687, and shall be made available to any interested party upon request. They may also be obtained on the Internet at http://dir.ca.gov/OPRL/DPreWageDetermination.htm.  The Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

 

Every Bid shall set forth information on subcontractors required by California Public Contract Code sections 4100 to 4114, inclusive.  Failure to list a subcontractor for a portion of work, if required, is a representation that the Bidder will perform that portion of work itself.

Untimely Bids will not be accepted or opened.

 

It shall be the responsibility of each prospective Bidder, upon discovery of any ambiguity or discrepancy in the bid form, specifications, or drawings, to bring such ambiguity or discrepancy to the attention of the District prior to the Bid date and time.  Failure to raise any such ambiguity or discrepancy prior to the Bid deadline shall waive the Bidder’s right to object to the ambiguity or discrepancy after bidding.

 

Bids shall be completed and submitted in a sealed envelope. On the face of the envelope, clearly write “Bid Proposal - Do Not Open” and indicate the Contractor’s Name and Address, and Bid Package # and Description. Failure to fully complete and submit all pages of the Bid Form may result in the Bid being rejected as non-responsive.

 

By submitting a bid, and in compliance with the Invitation to Bid, the Bidder agrees to furnish all labor, material, equipment, transportation, tax (including sales and use tax) and services for the work described in the Bid Documents for the price specified.  All costs for Bid Bonds, Labor and Material (Payment) Bonds and Performance Bonds shall be included in the Bid price.

 

An optional site visit will occur on February 19, 2019 at 3:00 PM to allow prospective Bidders to become familiar with the site.  Bidders should meet at Fairmont Charter Elementary no later than the time the site visit is scheduled to begin.  By submitting a Bid, the Bidder represents that it has visited the Project site and is familiar with the local conditions under which the Work will be performed.  Failure to visit the site will not relieve the Bidder of the responsibility for observing and considering those conditions which a contractor would have observed and considered during a site visit, estimating properly the difficulty and cost of successfully performing the Work or proceeding to perform the Work without additional cost to the District.

 

With its Bid, the Bidder must submit a Cashier’s Check, Certified Check or Bid Bond for ten percent (10%) of the total amount of the bid, made payable to the Vacaville Unified School District.  Failure to submit required bid security will result in the Bid being rejected as non-responsive.

 

Bids will be opened publicly and read aloud at the time and date established above. Bids shall not expire for 30 days after the Bid due date.

 

If awarded, the Contract will be awarded to the lowest responsive, responsible Bidder.  The District reserves the right to waive any irregularity in any Bid, and reserves the right to reject all Bids.  The successful Bidder will be notified via Notice of Intent to Award, and shall submit a Labor and Material (Payment) Bond and Performance Bond, each in the amount of 100% of the Contract Price, prior to issuance of the Notice to Proceed.

 

Any Bidder may file a protest against the award of the Contract to any other Bidder.  The protest must be in writing, filed within five (5) calendar days after the opening of bids, and must set forth all grounds for the protest.  Untimely protests and/or grounds not set forth in the protest will not be considered.  Failure to comply with these protest requirements waives the right to challenge the bidding process or the award in any administrative or judicial tribunal and forever bars the Bidder from bringing such a challenge.  The District will provide a written response to any timely bid protest.

NOTICE TO BIDDERS

 

ARTICLE 1. GENERAL

 

Section 1.01 Notice is hereby given that Landmark Modernization Contractors dba Landmark Construction, the selected Lease-Leaseback Entity will receive Proposals for:

 

Markham Elementary School Increment 1 - Site Improvement Project

 

This scope of this project includes:

  • Grading, building pads, concrete flatwork, paving, fire loop, and underground utilities for 27 future modular classrooms and new multipurpose building
  • Modular buildings are by others; concrete foundations by site contractor

 

Notice is hereby given that the Project is a public works project within the requirements of Division 2, Part 7, Chapter 1 of the California Labor Code, and that each Bidder are required to be registered with the Department of Industrial Relations (DIR) pursuant to Labor Code section 1725.5 at the time of bidding.  Failure of the Subcontractor to be registered at the time of bidding shall render the Bid non-responsive and unavailable for award. 

 

All subcontractors with the following license classifications that intend to bid to Landmark Construction and that are not already prequalified with the Vacaville Unified School District (“District”) are required to be prequalified by the District:  C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, and/or C-46 and all subcontractors holding a class A or B license that will perform any type of work covered by the specialty licenses listed. A list of prequalified contractors and electrical, mechanical, and plumbing Subcontractors is posted on the District’s website at http://measurea-vusd-ca.schoolloop.com

 

Contractors and subcontractors that are required to be prequalified are required to submit prequalification packages no later than thirty (30) days prior to bid date or within five (5) days of the last bid advertisement if advertised less than thirty (30) days before bids are due, but no later than ten (10) business days before bids are due.  The District will not consider any Bid in which the Bidder, or any Subcontractor that was required to be prequalified, is not actually prequalified within five (5) days before the bid date.

Contractor License Classification Required: Work to be performed under the Contract Documents requires a California State License Board Contractor License, consistent with the work to be performed by the Subcontractor and registration

with the state Department of Industrial Relations. The Bidder’s registration must remain active throughout the term of the Contract.

For all Pre-Bid visits (other than the Pre-bid conference), Bidder must make an appointment with the LLB Entity Representative prior to visiting the Site. DO NOT ACCESS THE SITE WITHOUT AN APPOINTMENT.

 

Section 1.03  Overall coordination of the Project will be the responsibility of the LLB Entity Representative.  All inquiries regarding the bid are to be directed to LLB Entity Representative, Ryan Andersen at randersen@landmarkconst.net

 

Section 1.04  Contracts for construction will be subcontracts with the LLB Entity. A sample copy of Landmark’s subcontract agreement has been provided for your review. Any proposed changes to these documents must be included with your proposal at the time of bid. Successful bidders must execute Landmark’s standard subcontract agreement.

 

Section 1.05  Each bid proposal shall conform to the requirements of the Contract Documents.  The bid documents may be obtained electronically at www.landmarkconst.net/plan-room. The subcontractor shall include in his/her bid all labor, materials, equipment, taxes, and insurance, as required for a complete scope of work and in conformance with the contract documents. The project requires prevailing wages be paid to all on site workers and adherence to state skilled and trained workforce requirements.

 

Section 1.06  Subcontractor bids must be submitted on the provided bid form, clearly identifying name, address, contact information, license number, and cost. By submitting a bid, you acknowledge and agree to all terms in Landmark’s subcontract agreement and the requirements noted here in.

 

Section 1.07  Fingerprinting will be required, please include considerations in your proposal for this expense.

 

Section 1.08  Landmark is an equal opportunity employer. Refer to General Conditions Section 00 7000, Article 7, Section 7.10.  The District encourages the participation of DVBE businesses.  Refer to Special Provisions Section 00 8000.

 

The District has set an overall goal of 3% participation by certified Disabled Veteran Business Enterprises (“DVBE”).  The participation may be through work or supply of materials. DVBEs are encouraged to provide proposals. Landmark is willing to break down work items into economically feasible units to facilitate DVBE participation. We are willing to assist qualified DVBE firms in obtaining bonds, lines of credit and/or insurance.

 

Section 1.09  The successful subcontract Bidder shall be required to pay its workers on this Project a sum not less than the general prevailing rate (applicable at time of bid advertisement date) of per diem wages and not less than the general prevailing rate for holiday and overtime work for work of a similar character in the locality in which the Project is performed, as provided under California Labor Code Sections 1726-1861. Section 1.10  Landmark Construction reserves the right to reject any and all proposals and to waive any irregularity in any proposals received.

 

Section 1.11  All plans and specification will be distributed electronically, via Landmark’s online plan room - no hard copies will be provided.

 

Section 1.12  Applicable trades shall have at least one supervising technician on call in the event that the existing fire alarm, security clocks, intercom, telephone and data systems are damaged during the course of construction or the Contract requires relocation of existing devices.  The supervising technician is required to be on Site during all aspects of repair, modifications and testing.  For fire alarm modifications and repairs the supervising technician is required to have at a minimum NICET LEVEL 2 Certification or equal.  The District may consider optional Underwriters Laboratories Certification, factory training or contractor demonstrated equal experience/training with prior approval.  The supervising technician must also have a minimum 5 years installation experience.

 

Section 1.13 Subcontractor Bonds may be required, but Landmark Construction will pay premiums up to 2% of contract amount if bonding is required. 

 

Section 1.14  Any work claimed by the Carpenters Union MUST be performed by signatory firms. This project requires the use of a skilled and trained workforce under Education Code section 17407.5 and Public Contract Code section 2601.  Education Code Section 17407.5 requires the use of a skilled and trained workforce, as defined by Public Contract Code section 2601, by subcontractors at every tier, to perform work which falls within an apprenticeable occupation in the building and construction trades. Verification of compliance must be submitted on a monthly basis.

 

Section 1.15 This is a collaborative lease-leaseback contract which is governed by a guaranteed maximum price. Our approach to lease-leaseback requires all of the project team members - owner, design team, inspector, general contractor, and subcontractors - to together look out for the best interests of the project, solving problems and moving the project forward. Subcontractors shall be responsible for proactively identifying and resolving all minor conflicts and problems with the plans and specifications, both prior to bid and during the course of the project.

Currently, the district employs local companies like A2R Architects (owned by a graduate of VHS), Lister Construction, Vaca Valley Excavating, Swank Construction, Cal Inc, Vista Environmental, Landscape and Pavers Inc, and Pacific Power Systems.

Thank you to the campaign volunteers, students, staff and entire community for helping us pass the Measure A bond by a 61% margin. Soon, VUSD will begin repairing, renovating, expanding and equipping our schools.
