INVITATION TO BID - Markham ES Toilet Building Relocation Project

INVITATION TO BID

 

 

Notice is hereby given that the Board of Trustees of the Vacaville Unified School District (“District”) will receive sealed Bids for the

 

Markham ES Toilet Building Relocation Project, Bid Package #17-07 (“Project”)

 

The Project consists of relocation and installation of two (2) portable toilet buildings and related site improvements at Markham Elementary School.

 

Required Contractors License Classification:  B

Notice is hereby given that the Project is a public works project within the requirements of Division 2, Part 7, Chapter 1 of the California Labor Code, and that each bidder and listed subcontractor is required to be registered pursuant to Labor Code section 1725.5 at the time of bidding.  Failure of the bidder or a listed subcontractor to be registered at the time of bidding shall render the bid non-responsive and unavailable for award.

 

The successful Bidder shall be required to pay its workers on this Project a sum not less than the general prevailing rate of per diem wages and not less than the general prevailing rate for holiday and overtime work for work of a similar character in the locality in which the Project is performed, as provided under California Labor Code sections 1720 through 1861. Copies of the prevailing rate of per diem wages are on file at the Vacaville Unified School District, 401 Nut Tree Road, Vacaville, CA 95687, and shall be made available to any interested party upon request.  They may also be obtained on the Internet at http://dir.ca.gov/OPRL/DPreWageDetermination.htm.  The Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations.

 

Every Bid shall set forth information on subcontractors required by California Public Contract Code sections 4100 to 4114, inclusive.  Failure to list a subcontractor for a portion of work, if required, is a representation that the Bidder will perform that portion of work itself.

Untimely Bids will not be accepted or opened.

 

It shall be the responsibility of each prospective Bidder, upon discovery of any ambiguity or discrepancy in the bid form, specifications, or drawings, to bring such ambiguity or discrepancy to the attention of the District prior to the Bid date and time.  Failure to raise any such ambiguity or discrepancy prior to the Bid deadline shall waive the Bidder’s right to object to the ambiguity or discrepancy after bidding.

 

Bids shall be completed and submitted in a sealed envelope. On the face of the envelope, clearly write “Bid Proposal - Do Not Open” and indicate the Contractor’s Name and Address, and Bid Package # and Description. Failure to fully complete and submit all pages of the Bid Form may result in the Bid being rejected as non-responsive.

 

By submitting a bid, and in compliance with the Invitation to Bid, the Bidder agrees to furnish all labor, material, equipment, transportation, tax (including sales and use tax) and services for the work described in the Bid Documents for the price specified.  All costs for Bid Bonds, Labor and Material (Payment) Bonds and Performance Bonds shall be included in the Bid price.

 

An optional site visit will occur on Thursday, March 16, 2017 3:45 PM to allow prospective Bidders to become familiar with the site.  Bidders should meet at Markham Elementary School, 101 Markham Avenue, Vacaville CA 95688, no later than the time the site visit is scheduled to begin.  By submitting a Bid, the Bidder represents that it has visited the Project site and is familiar with the local conditions under which the Work will be performed.  Failure to visit the site will not relieve the Bidder of the responsibility for observing and considering those conditions which a contractor would have observed and considered during a site visit, estimating properly the difficulty and cost of successfully performing the Work or proceeding to perform the Work without additional cost to the District.

 

With its Bid, the Bidder must submit a Cashier’s Check, Certified Check or Bid Bond for ten percent (10%) of the total amount of the bid, made payable to the Vacaville Unified School District.  Failure to submit required bid security will result in the Bid being rejected as non-responsive.

 

Bids will be opened publicly and read aloud at the time and date established above. Bids shall not expire for 30 days after the Bid due date.

 

If awarded, the Contract will be awarded to the lowest responsive, responsible Bidder.  The District reserves the right to waive any irregularity in any Bid, and reserves the right to reject all Bids.  The successful Bidder will be notified via Notice of Intent to Award, and shall submit a Labor and Material (Payment) Bond and Performance Bond, each in the amount of 100% of the Contract Price, prior to issuance of the Notice to Proceed.

 

Any Bidder may file a protest against the award of the Contract to any other Bidder.  The protest must be in writing, filed within five (5) calendar days after the opening of bids, and must set forth all grounds for the protest.  Untimely protests and/or grounds not set forth in the protest will not be considered.  Failure to comply with these protest requirements waives the right to challenge the bidding process or the award in any administrative or judicial tribunal and forever bars the Bidder from bringing such a challenge.  The District will provide a written response to any timely bid protest.

NOTICE TO BIDDERS - Will C. Wood High School Stadium Project

Notice is hereby given that the Project is a public works project within the requirements of Division 2, Part 7, Chapter 1 of the California Labor Code, and that each Bidder and all Subcontractors are required to be registered with the Department of Industrial Relations (DIR) pursuant to Labor Code section 1725.5 at the time of bidding.  Failure of the Bidder or a listed Subcontractor to be registered at the time of bidding shall render the Bid non-responsive and unavailable for award. 

 

Notice is hereby given that the Project is subject to the requirements of Public Contract Code section 20111.6 as a project funded under the Leroy F. Greene School Facilities Act of 1998 or a project that involves a projected expenditure of one million dollars ($1,000,000) or more and is funded from a state school bond.  As such, the District will accept Bids only from Bidders prequalified by the District.  In addition, any electrical, mechanical, and plumbing subcontractors (as defined by Public Contract Code section 20111.6(k) and all subcontractors holding a class A or B license that will perform any type of work covered by the specialty licenses listed in section 20111.6(k)) must be prequalified by the District.  The type of work for which subcontractors must be prequalified is the work encompassed in the following license classifications: C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43 and C-46, whether performed by a contractor with a Class C license or a Class A or B license. A list of prequalified contractors and electrical, mechanical, and plumbing Subcontractors is posted on the District’s website at http://measurea-vusd-ca.schoolloop.com

 

Contractors and subcontractors that are required to be prequalified are required to submit prequalification packages no later than thirty (30) days prior to bid date or within five (5) days of the last bid advertisement if advertised less than thirty (30) days before bids are due, but no later than ten (10) business days before bids are due.  The District will not consider any Bid in which the Bidder, or any Subcontractor that was required to be prequalified, is not actually prequalified within five (5) days before the bid date.

Attendance for duration of either the 1st or 2nd meeting is mandatory and each prime contract bidder (referred to as “Bidder” or “Bidders”) shall be required to certify, as part of its Proposal Form, that it attended the entirety of the Pre-Bid conference.  Failure to include the certification will render the bid non-responsive.  Failure to attend the mandatory, Pre-Bid conference waives the right to submit a bid. For all Pre-Bid visits (other than the Pre-bid conference), Bidder must make an appointment with the District Representative prior to visiting the Site.

 

Section 1.03  Overall coordination of the Project will be the responsibility of the District Representative.  All inquiries regarding the bid are to be directed to District Representative, Mike Wassermann, Mike@CapitalPM.com

 

Section 1.04  Contracts for construction will be direct prime contracts with the District. All Project procedures and documents are designed to facilitate delivery of the Project through prime construction contracts. The District's forms shall be used for all documents. Bidders shall read and review the Bidding Documents carefully, and shall familiarize themselves thoroughly with all requirements.

 

Section 1.05  Each bid proposal shall conform to the requirements of the Contract Documents.  The bid documents may be obtained at bidder’s expense from Signature Reprographics, (916) 454-0800 or electronically at signaturerepro.com.

 

Section 1.06  No bid will be considered unless it is accompanied by Cashier's Check, Certified Check or Bid Bond from a surety authorized to do business in California for ten percent (10%) of the total amount of the Combined Base Bid Amount, including additive Alternate Bids, made payable to the District. The above-mentioned check or bid bond shall be given as a guarantee that the Bidder shall, if selected by the District, execute the Contracts, in conformance with the Contract Documents. For more information, refer to Section 00 2000, Article 1, Section 1.06.

 

Section 1.07  Bids shall not expire for a period of 90 days after the date set for the bid opening. Within ten (10) days after notification of the District’s Notice of Intent to Award the Contracts, the successful Bidder will be required to furnish a Labor and Material Bond and a Faithful Performance Bond for each Contract. For further information, refer to Sections 00 6113.13 and 00 6113.16.

 

Section 1.08  The District is an equal opportunity employer. Refer to General Conditions Section 00 7000, Article 7, Section 7.10.  The District encourages the participation of DVBE businesses.  Refer to Special Provisions Section 00 8000.

 

The District has set an overall goal for this Project that Bidders obtain a minimum of 3% of their bid amount in participation by certified Disabled Veteran Business Enterprises (“DVBE”).  The participation may be through work or supply of materials. If a Bidder is unable to obtain the full 3% participation by one or more DVBEs, then the bid may be found responsive only if it establishes “good faith efforts” to meet the goal.  The requirements for good faith efforts are set forth in Special Provisions Section 00 8000, Article 4 and the attachments thereto.

 

Section 1.09  The successful Bidder shall be required to pay its workers on this Project a sum not less than the general prevailing rate (applicable at time of bid advertisement date) of per diem wages and not less than the general prevailing rate for holiday and overtime work for work of a similar character in the locality in which the Project is performed, as provided under California Labor Code Sections 1726-1861. Section 1.10  The governing board of the District reserves the right to reject any and all proposals and to waive any irregularity in any proposals received.

 

Section 1.11  At the request and expense of the successful Bidder, eligible securities shall be accepted in lieu of retention payments to insure performance under the Contract, pursuant to California Public Contract Code Section 22300. Refer to Exhibit H and General Conditions Section 00 7000, Article 12, Section 12.05. Said securities shall be deposited prior to the submission of the successful Bidder’s first progress payment application.

 

Section 1.12  The successful Bidder shall have at least one supervising technician on call in the event that the existing fire alarm, security clocks, intercom, telephone and data systems are damaged during the course of construction or the Contract requires relocation of existing devices.  The supervising technician is required to be on Site during all aspects of repair, modifications and testing.  For fire alarm modifications and repairs the supervising technician is required to have at a minimum NICET LEVEL 2 Certification or equal.  The District may consider optional Underwriters Laboratories Certification, factory training or contractor demonstrated equal experience/training with prior approval.  The supervising technician must also have a minimum 5 years installation experience.

VUSD has made extensive efforts to engage local contractors in Measure A projects. Currently, the district employs local companies like A2R Architects (owned by a graduate of VHS), Lister Construction, Vaca Valley Excavating, Swank Construction, Cal Inc, Vista Environmental, Landscape and Pavers Inc, and Pacific Power Systems.

Groundbreaking at VHS

Modernizations at Vaca High

We have started the Vacaville High School Parking Lot/Tennis Court Project. The purpose of this project is to provide additional parking at VHS. The project includes relocating the tennis courts and reconfiguring the parking lot. This will create additional parking spaces and improve the flow of traffic.

Measure A modernizations for Vacaville High School also include the addition of classrooms. The new two-story classroom building project has begun with the feasibility study. Construction phase for the classrooms is scheduled to begin April of 2017.
